The goal of the State of West Virginia under the Family Law Code is to always promote what is in the best interest of the child. Typically, this is interpreted to mean reunification of a child with their parents whenever possible. When the State of West Virginia has taken action to terminate the parental rights of a child’s biological parents, an eligible interested family member or eligible non-related party with legitimate standing, such as a foster parent, may petition the state to consent to the adoption.
